How to buy an apartment as a foreigner in Marbella?

Requirements:

  • Real estate selection.
  • Find a lawyer and translator.
  • For real estate booking - signing a prepayment agreement, which guarantees compliance with the Terms of purchase, previously agreed on by both parties.
  • Get an NIE.
  • Prepare documents.
  • Check real estate documents.
  • If necessary, issue a mortgage.
  • Sign a purchase and sale agreement.
  • Pay tax for the real estate purchase. If secondary housing is purchased, then the property transfer tax (ITP) is applied, the tax base of which is the purchase and sale price:
    • up to 400,000 € - 8%;
    • from 400,000 to 700,000 € - 9%;
    • from 700,000 € and above - 10%.

Due to tax cuts approved on April 27, 2021, the buyer must pay 7% in ITP regardless of the house price. However, this only applies to house purchases made before December 2021.

If the dwelling is newly built, 10% VAT and 1.5% stamp duty are payable. Note that until December 31 of this year, there is a reduction in stamp duty, to 1.2%.
