Spanish Ministry of Industry is preparing a decree on foreign investment

The Ministry of Industry is preparing a new decree on foreign investment, which will soften the control mechanisms.

New rules mean changes in energy issues. The decree facilitates the sale of renewable energy projects to foreign funds.

The resolution explains that investors who are not associated with regulated activities (such as the operation of the electricity system and market, transmission and distribution of electricity, electricity supply in non-mainland territories, technical management of the gas system, as well as regasification, basic storage, transportation and distribution of natural gas) may be exempt from the need to request permission for investments exceeding EUR 5,000,000.

Permits may also not be obtained, provided that as a result of the transaction, the company does not acquire the status of a monopolist in the production of electricity, production, storage, transportation and distribution of fuel or biofuels, production and supply of liquefied petroleum gases or production and supply of natural gas.

If foreign investments are associated with the acquisition of electricity generation assets, permission may not be obtained as long as the share of installed capacity is less than 5%.

If foreign investments are related to the acquisition of companies selling electricity, they may not request permission, provided that the number of customers of the company does not exceed 20,000.
